Thanks for using GoKiiw. These Terms of Service (“TOS”) govern the use of the GoKiiw Queue Management System (“Software” or “GoKiiw”) provided by SoftAfrique LLC (“we” or “us”) and accessed on www.gokiiw.com and GoKiiw apps by our Clients (“you”). By accessing or using the Software, you agree to be bound by these TOS. If you do not agree to these TOS, you SHOULD NOT use the Software.

Licence to Use

Paying the applicable fees for the Software gives you a non-exclusive right, solely as expressly permitted by this TOS, to access, use, customise, store, view, and display the Software on your devices by yourself or your authorised staff and personnel for your events or business or other lawful purposes. All rights, title and interest in GoKiiw Queue Management Software, www.gokiiw.com and GoKiiw Apps ARE NOT expressly granted to you in this TOS.

Use of Software

The Software is intended for use by individuals and businesses to manage customer queues and wait times. You may use the Software for lawful purposes only. You may not use the Software for any illegal or unauthorized purpose, or in any manner that interferes with the normal operation of the Software.


Dangerous activities

This Software is not intended for use in the operation of emergency communications, aircraft navigation or communication systems, air traffic control systems, or any activities in which case the failure of the Software or app could lead to death, personal injury, or severe physical or environmental harm.

Modification of TOS

SoftAfrique LLC reserves the right to modify the TOS, in whole or in part, at any time.  SoftAfrique LLC will give you at least 30 days notice and the new TOS will be effective after such notice period. The revised TOS will also be posted on the GoKiiw website, www.gokiiw.com. It is important that you review the Terms whenever we modify them because your continued use of the Software following any such modification constitutes your acceptance of the revised TOS. However, if you do not agree with the changes, you must download your information and cancel your account.


  1. Updates

The Software, related support libraries and content, may need to be updated to fix bugs, enhance functions, and improve versions. By agreeing to these Terms and using GoKiiw, you agree to receive such updates. If it is determined that such updates are necessary to enhance the functionality of the content, improve access of the Software, to fix security vulnerability, or to prevent abuse, then the update will be completed irrespective of the update settings on your device.


  1. User Accounts

In order to use the Software, you must create an account. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, tablet or mobile. You agree to accept responsibility for all activities that occur under your account or password.

You MUST NOT share your username and password in order to give other people or businesses free access to the software or your account.

You can however create user accounts for staff or other authorised personnel, as well as for clients who join queues.

You can also suspend, delete and modify accounts at any time from the dashboard.


  1. Free Trial

You will have an initial free trial of 14 days to try out the software. If you want to continue using the Software after this period, you will need to pay the appropriate fees depending which package you choose.


  1. Pricing

Packages and prices are subject to change at any time prior to purchase. However, if you are already a Client, we will send you an email 8 weeks before any package and price increases are to be effected. If you do not wish to pay the increased price for using the Software, you may cancel your account before the date the price increase will be effected on your account and you will not be charged further. Information on current packages and pricing can be found on www.gokiiw.com.


  1. Payment processing

Payment is by monthly or annual direct debit from the credit card you provide. You are responsible for ensuring that you replace expired credit card information and ensuring that you have enough money in your bank account to cover the payment of your fees. However, if we are unable to process the payment of your fees for any reason, we will send you an email and give you 14 days to rectify the problem before we try to process the payment again. 


  1. Cancellation

You can cancel your account at any time before the end of the applicable billing period. Once you cancel your account, you will not be charged for the following month or year and you can continue to use the Software for the period you have paid for. Once the billing period ends, you can no longer log into your account, use the Software, or access your data. You are responsible for downloading all your information before the billing period ends.


  1. Refunds

Our Software is so awesome that we give you a 100% money back guarantee. Within 14 days of payment, if you are not satisfied with our queue-busting solutions for any reason, simply click on the Contact Us button on the website or email support@gokiiw.com to request a refund. We will process your refund within 5 working days. Once your refund is processed, your account will be terminated and you will no longer be able to use the Software. You are responsible for downloading all your information within 5 days of requesting a refund.


  1. Termination

SoftAfrique LLC may terminate your use of the Software at any time without notice if you use the Software for unlawful and illegal purposes and if you do not conform to these TOS in any other way. Upon any termination, your right to use the Software and access your data will immediately cease.


  1. Taxes

Taxes mean any duties, custom, fees, levies or taxes associated with your purchase of the Software. If SoftAfrique LLC is obligated to collect any taxes, these taxes will be charged to you and your payment will include these applicable taxes. However, you are responsible for reporting and paying any taxes that arise in connection with your use of the Software.


  1. User Content

The Software may allow you to submit, upload, publish or otherwise make available content, including but not limited to text, photographs, and videos (“User Content”). You retain all rights in and to your User Content. By making any User Content available through the Software, you grant to SoftAfrique LLC a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, copy, modify, create derivative works based on, distribute, publicly display, publicly perform, and otherwise exploit your User Content in connection with operating and providing the Software.

  1. Disclaimers

The Software is provided on an “as is” and “as available” basis. SoftAfrique LLC makes no representations or warranties of any kind, express or implied, as to the operation of the Software or the information, content, materials, or products included on the Software. SoftAfrique LLC does not warrant that the Software will be uninterrupted or error-free, and SoftAfrique LLC will not be liable for any interruptions or errors.

  1. Limitation of Liability

SoftAfrique LLC shall not be liable for any direct, indirect, incidental, special, or consequential damages, including but not limited to, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your use of the Software; (ii) unauthorized access to or alteration of your transmissions or data; or (iii) any other matter relating to the Software.


  1. Indemnification

You agree to indemnify, defend, and hold harmless SoftAfrique LLC, its officers, directors, employees, agents, licensors, and suppliers from and against all losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from any violation of these TOS or any activity related to your account (including negligent or wrongful conduct) by you or any other persons accessing the Software using your account, or your personnel or client accounts.

  1. General Terms

These TOS, with our Privacy Policy and Refund Policy, constitute the entire agreement between you and SoftAfrique LLC and supersede any prior agreements. Please refer to our Privacy Policy and Refund Policy for further information about how we use your information and how we process refunds.
